I doubt it's a guitar with a capo on the 12th fret. On the past couple of albums Steven has been using an acoustic guitar in Nashville tuning. If you're not familiar with Nashville tuning, it's like a 12 string guitar without the normal guitar strings, just the higher octave strings.
