An open low E string would prove which tuning it is. Almost all artists strum open strings at some point while they play. Listen carefully. I think I can deduce that it's supposed to be tuned down half a step because of the simple I-V-IV progression (Eb major, Bb major and Ab major in flat tuning) used through most of the chorus, as a mistake such as strumming open strings would not effect the song. If it was in regular tuning an open string mistake would sound terrible so I doubt that Billy would set himself up for that. (Just try it yourself! The open E is too sharp) Another note is that almost all other songs from this time period were tuned similarly and so it would make sense given time constraints. (consider other albums where particular tunings are widely used.) It always helps to keep dynamics in mind when tabbing. Billy mentions in an interview with Chris Issack on his website that he focused on dynamics to bring out the power of his melodies. Still, he is pretty crazy and I wouldn't be suprised if he did play this in standard all the while knowing he couldn't touch the open E string.
